Libertarianism.org’s Survey Sweepstakes (“Sweepstakes”) Official Rules

1. Sponsor: The “Sponsor” of the Sweepstakes is the Cato Institute, located at 1000 Massachusetts Ave., N.W., Washington, D.C. 20001. Sponsor is a 501(c)(3) nonprofit institution. The Sponsor is also the owner of the Libertarianism.org website.
2. Eligibility: The Sweepstakes is open only to legal residents of the 50 United States, Washington, D.C., or any US territory who: (a) are 18 years of age or older; and (b) reside in one of the 50 States, a US territory, or Washington, D.C. at the time of entry. Employees, contractors, directors and officers of Sponsor and their immediate family members (parent, child, sibling, and spouse of each, regardless of where they reside) are not eligible.
3. Sweepstakes Period: The Sweepstakes begins at 12:00 a.m. Eastern Standard Time on November 5, 2023, and ends at 4:00 p.m. Eastern Standard Time on November 17, 2023 (the “Sweepstakes Period”). Only Eligible Entries (defined below) received within the Sweepstakes Period shall be valid and considered.
4. How to Enter: To enter the Sweepstakes, potential entrants must fully complete and successfully submit the Voice Your Libertarianism Survey (the “Survey”) posted at the following url: https://forms.office.com/Pages/ResponsePage.aspx?id=IQB119TSFkucKbF8pY0ar_6hGjDYPL1Po__ppdW6jvRUQ1I0RlRLWk9LQUVDVUlNRjBFSkVaU0pYWS4u within the Sweepstakes Period and the Survey must include their name and requested contact information (an “Eligible Entry”). Upon successful completion of an Eligible Entry, the individual shall be an “Entrant.” All Entrants and individuals are limited to one (1) Eligible Entry and will not receive any other entry regardless of the number of times they complete the Survey. To enter the Sweepstakes without completing the Survey, an Entrant must email marketing@libertarianis.org with “Libertairianism.org November Sweepstakes” in the subject line and provide their name, email, and any other requested contact information.

No purchase is necessary to enter or win.

Any Entrant or individual found to have violated any rule contained herein shall be disqualified from the Sweepstakes Winner Selection (defined below) and any and all Eligible Entries shall be deemed void regardless of whether their attempted entry was made in compliance with these official rules. All incomplete or non-conforming Surveys will not constitute an Eligible Entry. By entering, all individuals and Entrants expressly consent to their personal information (including name and general geographical location) and image being collected, used, promoted, shared, posted, or marketed by Sponsor.

1. Sweepstakes Winner Selection: One winner (a “Sweepstakes Winner”) shall be randomly selected from the pool of Eligible Entries within three weeks from the end of the Sweepstakes Period (the “Sweepstakes Winner Selection”). The Sweepstakes Winner will be notified via email.

The odds of winning will depend on the total number of Eligible Entries received and the more Eligible Entries entered, the lower your chance of winning. The identity of the Sweepstakes Winner can be obtained by emailing marketing@libertarianis.org after the Sweepstakes Winner is announced. By entering, the Sweepstakes Winner expressly consents to their personal information (including name and general geographical location) and image being collected, used, promoted, shared, posted, or marketed by Sponsor.

1. Prizes, Approximate Retail Value (“ARV”):

There will be one (1) Prize awarded. A “Prize” will consist of a $50.00 gift card to Amazon (the “Gift Card”) and a signed copy of the publication entitled “Visions of Liberty,” signed by then current staff members of Libertarianism.org (the “Publication”). The Sweepstakes Winner’s use of the Gift Card must be in conformance with the terms and conditions of the third-party issuer of the Gift Card and merchandiser accepting the Gift Card. Sponsor makes no warranty concerning third-party Gift Card or the Sweepstakes Winner’s ability to use them.

Total ARV of the Prize (including all components thereof) is $70.00 USD (ARV of the Gift Card is $50.00, and ARV of the Publication is $20.00). No substitution, cash redemption, or transfer of the Prize is permitted except at Sponsor’s sole discretion or as provided herein. If the advertised Prize or any component thereof cannot be awarded for any reason, Sponsor reserves the right to substitute a Prize or component of the Prize of equal or greater value. All federal, state and local income taxes on the Prize and all other costs associated with acceptance or use of the Prize is the sole responsibility of the Sweepstakes Winner. Arrangements for delivery of the Prize will be made after Sweepstakes Winner validation. LIMIT ONE (1) PRIZE PER SWEEPSTAKES WINNER. Unclaimed Prizes shall not be awarded. Upon request, Sponsor shall provide a 1099 form to the Sweepstakes Winner.

1. General Rules: All applicable federal, state and local laws apply. The Sweepstakes Winner will be contacted by email, and may be required, at Sponsor’s discretion, to complete, sign and return an affidavit of eligibility, a liability release (where lawful), a publicity release, and/or any other contractual agreement deemed necessary within a stated amount of time set by Sponsor. Any Entrant that does not agree to sign these documents will be disqualified from receiving the Prize or being designated a Sweepstakes Winner. The return of any notification as undeliverable, or failure to respond to notices, or failure to sign and return any required documents in a timely manner, or a determination that a potential winner is ineligible or not in compliance with these official rules as determined solely by the Sponsor, may result in disqualification of the Sweepstakes Winner and forfeiture of the corresponding Prize. In the event of a disqualification, the Sponsor may opt at its sole discretion to select another winner. By participating in this Sweepstakes, Entrants agree to abide by and be bound by these official rules and decisions of the Sponsor, which shall be final in all matters relating to the Sweepstakes.

Sponsor is not responsible for: (i) electronic or digital transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation of transmission, communication failures (including but not limited to failures or malfunctions of phone lines, telephone systems or other communications systems), destruction of or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or other transmissions; (iv) damage to Entrants’ or any individual’s computer; (v) causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; (vi) incorrect or inaccurate entry information whether caused by Entrants or by any of the equipment or programming associated with or utilized in the Sweepstakes; (vii) cheating or fraud by any Entrant or individual; and/or (viii) the actions of any social media site or other non-Sponsor controlled site, app, website, or other platform. By entering this Sweepstakes (or attempting to enter the Sweepstakes), the Entrant or individual attempting to enter expressly waives any claim against Sponsor arising from any of these conditions.

If for any reason this Sweepstakes cannot be executed as planned, including but not limited to infection by virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity, or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes corrupted in any way, electronically or otherwise, Sponsor reserves the right, in its sole discretion, to suspend or terminate this Sweepstakes and no Prize shall be awarded.

This Sweepstakes is void where prohibited.

As a condition of entering the Sweepstakes or winning a Prize, all Entrants hereby agree to (1) assign in perpetuity all ownership rights (including any copyright or moral rights), both those currently in existence and those that may come into existence in the future, of their Eligible Entry to Sponsor for its use; and (2) allow Sponsor to promote and market them, use their image, name, general geographic location, and social media information in such promotion, and cooperate with Sponsor in such promotion.

This Sweepstakes is in no way sponsored, endorsed by, administered, or associated with any individual or entity beyond the Sponsor.

CAUTION: ANY ATTEMPT BY ANY PERSON OR ENTITY TO DELIBERATELY CORRUPT OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY THE ENTRANT AND VOID THEIR ENTRY AND PROSECUTE AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.

1. Release, Indemnification & Waiver: By participating in this Sweepstakes, Entrants (and individuals that attempt to submit an Eligible Entry) agree to indemnify, release, discharge, and hold harmless Sponsor, and its respective owners, officers, directors, employees, representatives, agents, subsidiaries and assigns from and against any and all liability, loss, injuries, or damages associated with participation in this Sweepstakes or the acceptance, possession, use or misuse of any Prize (or component thereof) received in this Sweepstakes. By participating or attempting to participate in this Sweepstakes, Entrants and/or individuals attempting to submit an Eligible Entry waive all rights to claim punitive, indirect, incidental, and consequential damages, recovery of costs and attorneys’ fees, or any damages other than actual out-of-pocket costs incurred to participate.
2. Disputes/Venue/Governing Law: By participating or attempting to participate in this Sweepstakes, any Sweepstakes Winner, and any Entrants and individuals attempting to submit an Eligible Entry agree that (1) any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or any Prize (or component thereof) awarded (if applicable) shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Washington, DC, and consent to the jurisdiction of local or federal courts located in Washington, DC; (2) any and all claims, judgments and awards asserted by them shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Sweepstakes, but in no event recovery of costs and attorneys’ fees; and (3) to the extent allowed by applicable law, under no circumstances will they be permitted to obtain awards for, and hereby waive all rights to claim, punitive, indirect, incidental, and consequential damages, and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules or the rights and obligations of any participant or Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of Washington, DC, and/or applicable federal law, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.

The invalidity or unenforceability of any provision of these official rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these official rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials or notifications and the terms and conditions of these official rules, these official rules shall prevail, govern and control.

Intellectual Property: All trademarks, brand names, copyrights, or other intellectual property rights used as part of the Sweepstakes are the property of their respective owners. “Cato Institute” is a registered trademark of Sponsor. The terms “Libertarianism.org” and “Visions of Liberty,” and their associated logos, are owned wholly by Sponsor.
